Terms of Service
In the following, we would like to provide you with our general terms and conditions which apply to the contracting, handling and processing of your purchase at bra4jewellery and which you accept by sending the online order.
- Conclusion
1.1. Contracts on www.bra4jewellery.com are concluded in German and English. In the case of differences or reenactments between the German and English versions of the contracts, the German language version shall prevail. In the case of orders with bra4jewellery, the contractual partner of the customer is ERNST&ERNST Design AG, CHE (…), based in Lucerne, Zinggentorstrasse 7, 6006 Lucerne.
1.2. By clicking the “buy now” button with the prior consent of the General Terms and
Conditions, the customer makes a binding order via the articles in the shopping basket and accepts the present general terms and conditions of business. ERNST&ERNST Design AG shall acknowledge receipt of the order immediately after sending the order by email (order confirmation). A binding contract comes with the receipt of this order confirmation.
1.3. The provisions of the General Terms and Conditions of the Purchaser which are contrary to these General Terms and Conditions of Business shall not apply.
- Prices, delivery, shipping charges, duties and import charges
2.1. The prices stated in the offer at the time of the order are valid in Swiss francs. The currency calculator is stored in the shop and converts the prices into the desired currency (Euro or USD). We accept no liability for price differences due to this currency calculator. The prices are without shipping charges, customs fees, value added tax and any other government fees and administration costs.
2.2. Delivery takes place from the company address of ERNST&ERNST Design AG in Switzerland. The shipping will be made within 3-5 working days, as long as all accessories are in stock for the creation of the product. The buyer / recipient is obligated to pay the respective customs fees, value added tax and any other government duties and administration costs in the recipient country, which are not included in the price.
2.3. The Purchaser acknowledges that ERNST&ERNST Design AG is not obliged to deliver the ordered goods if ERNST&ERNST Design AG has ordered the parts for the production of the goods properly, but has not been supplied correctly or on time. The prerequisite is that ERNST&ERNST Design AG is not responsible for the missing availability of the goods and that the customer was informed of this fact after receipt of the order. The payment already made will in this case be returned to the customer without delay. Any claims for damages of the customer arising in this case do not arise.
2.4. The goods are dispatched by Swiss Post AG, or by their subsidiary companies at the prices and conditions stated by these, which are invoiced to the purchaser.
- Payment
3.1. Payment is by Paypal or Stripe in advance. Any fees for this transfer shall be borne by the customer.
- Buyer
4.1. For reasons of hygiene, goods can not be exchanged. After prior written agreement with ERNST & ERNST Design AG, an exchange may be agreed in exceptional cases if the goods have not previously been used. With the return of the goods you automatically confirm that you have not worn the goods before.
4.2. The period for exchange is 7 days (arrival of the goods to be exchanged at ERNST & ERNST Design AG) after receipt of the goods. The customer will pay the port costs for the return, as well as for the re-transmission of the substitute product, or will be billed.
- Warranty
5.1. The statutory guarantee applies under Swiss law. The customer has to examine the goods as soon as it is practicable according to the normal course of business. Should delivered goods be defective, the customer shall notify ERNST&ERNST Design AG immediately in writing. Otherwise, the goods are considered as approved.
5.2. ERNST&ERNST Design AG expressly reserves the right to supply the purchaser with defect-free replacement in the case of alleged and ascertained defects of the purchased goods.
- Liability
6.1. ERNST&ERNST Design AG accepts no liability for damages caused by improper use of our articles on persons or material. The user must check whether any possible silicone or metal allergy of the customer exists. ERNST&ERNST Design AG is not liable for any damages.
6.2. In all cases, the liability of ERNST&ERNST Design AG for slight or medium negligence shall be excluded, insofar as there is no personal injury or the route condition is forbidden for other reasons. The liability of ERNST&ERNST Design AG for auxiliary persons is completely excluded.
- Force majeure
7.1. In the event of non-fulfillment or non-fulfillment of the contract or part of the contract as a result of force majeure (such as but not limited to accidents, fire, explosions, floods, natural catastrophes, strikes or labor disputes, sabotage, unrest, terrorism, war or civil war, Restrictions on the part of governments and authorities), ERNST&ERNST Design AG is not responsible. In particular, the purchaser shall not be authorized to rescind the contract, nor will claims for damages be justified.
- Data Protection
8.1. The customer data are collected, processed and used according to the provisions of the Swiss Data Protection Act. The customer data are only used within ERNST&ERNST Design AG, their branches and associated companies and are not passed on to third parties.
- Applicable law and jurisdiction
9.1. The Swiss law applies to all legal transactions with ERNST&ERNST Design AG and, in particular, these general terms and conditions. The United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (UN Convention on Contracts for the International Sale of Goods and CISG) and any other intergovernmental agreements shall not apply.
9.2. The exclusive jurisdiction is Lucerne.
